1. Acceptance of Terms

By accessing or using the Lumio AI application ("Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Lumio AI ("Company," "we," "us," or "our").

2. Description of Service

Lumio AI is a mobile application that uses artificial intelligence technology to help users visualize and design home interiors and exteriors. The Service allows users to upload photographs of their spaces and receive AI-generated design suggestions, style transformations, furniture placement recommendations, paint color visualizations, and other home design features. The Service is provided on an "as-is" and "as-available" basis.

3. User Accounts

To access certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, not current, or incomplete.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to: (a) use the Service in any way that violates any applicable federal, state, local, or international law or regulation; (b) upload, transmit, or distribute any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable; (c) attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service; (d) use the Service to generate content that infringes upon the intellectual property rights of others; (e) use automated means to access the Service for any purpose without our express written permission.

5. Intellectual Property

The Service and its original content (excluding user-provided content), features, and functionality are and will remain the exclusive property of Lumio AI and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Lumio AI. You retain ownership of any photographs or images you upload to the Service.

6. AI-Generated Content

The design suggestions, visualizations, and recommendations provided by the Service are generated by artificial intelligence and are intended for inspirational and informational purposes only. AI-generated content should not be relied upon as professional architectural, structural, or interior design advice. We do not guarantee the accuracy, feasibility, safety, or suitability of any AI-generated designs. Before implementing any design changes to your property, we strongly recommend consulting with qualified professionals including licensed architects, contractors, and interior designers. The Company is not responsible for any damages, losses, or injuries resulting from the implementation of AI-generated design suggestions.

7. Limitation of Liability

In no event shall Lumio AI, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from: (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; (d) unauthorized access, use, or alteration of your transmissions or content; or (e) the implementation of any design suggestions provided by the Service. Our total liability shall not exceed the amount you have paid to us in the twelve months preceding the claim.

8. Subscription and Payments

Certain features of the Service require a paid subscription. Subscription fees are billed in advance on a recurring basis according to the plan you select. You authorize us to charge your chosen payment method for all fees incurred. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Refunds are handled in accordance with the policies of the applicable app store (Apple App Store or Google Play Store).

9. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
